FDA Structure/Function Claims: What the Wording Allows and the Notice It Requires
A structure/function claim describes a nutrient's or ingredient's role in the body's structure or function, and must carry the notice that FDA has not evaluated it. Companies notify FDA within 30 days of marketing. The claim may not say a product treats or prevents disease. SodaPeak's wording is supports healthy muscle.

The claim01
What is a structure/function claim?
A statement of the role a nutrient or ingredient plays in the body's structure or function.
FDA says it must carry the boldface disclaimer: this statement has not been evaluated by the Food and Drug Administration, and the product is not intended to diagnose, treat, cure or prevent any disease (FDA, Structure/Function Claims). The claim may not say the product diagnoses, mitigates, treats or prevents a disease.
The rules02
What does the company have to do?
Notify FDA, hold substantiation and print the notice.
| Requirement | Detail |
|---|---|
| Notification | To FDA within 30 days of marketing |
| Notice on the label | The boldface FDA statement |
| Substantiation | The firm must have it (FDA, Q&A on Dietary Supplements) |
| FDA approval | None. Notification is not approval |
The FTC adds that health claims need competent and reliable scientific evidence, and that the disclaimer does not rescue a deceptive claim (FTC, Health Products Guidance).
SodaPeak03
How does SodaPeak's wording fit?
Supports healthy muscle, with an asterisk pointing to the notice.
That is permitted wording. It is not a finding that the blend does so, and this site makes no further claim. The disclaimer page sets out the statement and the benefits page compares each possible claim with its evidence.
SUPPORTS HEALTHY MUSCLE*
A structure/function line: the star leads to the FDA statement. No source linked here tests SodaPeak. Muscle responds to training on 2 or more days a week, protein and sleep, and the sources on this site say so. (FDA, Structure/Function Claims) (CDC, Adult Activity)
Test Boost Proprietary Blend 1200mg
A blend name and one total. The panel prints no amount for any of the eight names, so the real split is unknown. The blend name is not a finding: no study tested this blend. (21 CFR 101.36 (eCFR))
ADVANCED FORMULA
A product description. It names no ingredient, amount, test or standard. (FDA 101: Dietary Supplements)
*Daily Value Not Established
No Daily Value exists for these names, so the panel cannot show a percent of one. It is not a measure of how much to take. (FDA, Q&A on Dietary Supplements)

How do I spot wording that goes too far?
Look for disease words, hormone words and promises of speed.
FDA says a product intended to treat, prevent, cure or ease disease is regulated as a drug even if labeled a supplement (FDA 101: Dietary Supplements). Wording about quick fixes appears on its list of tip-offs (FDA, 6 Tip-offs to Rip-offs).
Ordering05
What should I take from this?
That the wording is the maker's, not a verdict.
