The rule01
What does the FTC rule ban?
Fake or false reviews, including AI-generated and fake celebrity ones, paid positive reviews, undisclosed insider reviews, seller-run independent review sites and review suppression.
The FTC announced the rule August 14, 2024, and it lets the agency seek civil penalties against knowing violators (FTC, Fake Reviews Rule (2024)). It took effect October 21, 2024, and paying for positive reviews is prohibited even on third-party platforms (FTC, Reviews Rule Q&A).
Six checks02
How can I spot a fake review?
Look at timing, detail, history, wording, balance and disclosure.
| Check | Warning sign |
|---|---|
| Timing | Many reviews posted on the same days |
| Detail | Praise with no dose, date or specifics |
| Reviewer history | One review ever, or only this brand |
| Wording | Repeated phrases across reviews |
| Balance | No review below four stars |
| Disclosure | No mention of free product or pay |
Endorsements03
What do endorsement rules add?
An endorsement must reflect the endorser's honest opinion, and paid or gifted relationships should be disclosed clearly.
The FTC says endorsers cannot describe experiences with a product they have not tried, and that fake likes and fabricated engagement are deceptive (FTC, Endorsement Guides Q&A). FDA adds that online reviews can be fake (FDA, 6 Tip-offs to Rip-offs).
Tick the lines you see. Each one lights a flag and a one-line reason.
Reasons drawn from (FDA, Tainted Sexual Enhancement) (FDA, Bodybuilding Products) (FDA, Testosterone Information) (FDA 101: Dietary Supplements) (FDA, Q&A on Dietary Supplements) (FDA, Structure/Function Claims) (21 CFR 101.36 (eCFR)) (FDA, 6 Tip-offs to Rip-offs) (FTC, Health Products Guidance) (FTC, Fake Reviews Rule (2024)) (FTC, Endorsement Guides Q&A). A clean checklist is not proof a product is safe: FDA says a product missing from its warning lists is not thereby safe.
